Requesting breaks during telephone WCA was created by SurlyRider
Hi,
Apologies if this has already been covered , I cant see it anywhere and I have limited ability to use screens.
I have an upcoming telephone call for long covid , I will need to make the the assessor aware that I need a break of 10 mins every 20 mins of talking , do I call and request this in advance?
Also, am I permitted torwcord the interview myself or do I request this before the call, also?
Thnakyou in advance.

Hi Sarah
If you want them to record the interview you need to request it now. Be warned, they may now change the date of your assessment, if they can't find an assessor to agree to do it.
You can record the interview yourself, but this has to be done covertly. If you tell them you are recording it, they will stop the interview at once.
I would make the request for breaks now. They should give a break when you need one, but not all are particularly accomodating about this - so I would pre-warn them.

Thanks very much for your help. Do I need to request the recording by letter ( I see there is a template here) ?
Thanks again.
Thanks again.

Hi Sarah
You can do it by post or phone, but as previously stated by BIS if you ask for it to be recorded they may delay the assessment date.
You can legally record a telephone call without informing the other party providing the recording is being made for your personal use. In fact, do not tell the assessor that they are being recorded as they will likely terminate the assessment.
If you are using a smartphone then there are apps that will do this for you.
If you are using a landline and can put the call on speakerphone then you can record it using either a smartphone or some other recording device,
If it's a landline but you cannot put it on speakerphone then you will need a special microphone that attaches to the earpiece.

Thanks very much for this, it's really helpful.
I assume if I record it for personal use that would mean I cant refer to it if I have to appeal.
I have waited over 7 months for this interview (!) But am able to wait longer if the recorded interview carries a higher chance of success ? Or rather a lower chance of being manipulated and thrown out. If that makes sense?
On balance if it's not likely to make much difference then I will go ahead but just request breaks.
Are you able to offer any advice on that at all please?
Many thanks again for all you do.

Hi Sarah
If you do a covert recording - and need to make a Mandatory Reconsideration - the DWP won't look at it. You can however use a transcript of a cover recording at an appeal.
We can't say whether you have a better success of being given an award if you have your assessment recorded by the DWP or not - because there is no current data on it. If there is a recording by the DWP it would be hard for them to dispute what was said - however, things that are said are always open to interpretation so there are no guarantees.
We can't advise you what to do on this - I'm afraid it is something that you will have to decide for yourself.
