After some advice re Pip MR, recorded assessment

Hi, I will just give you a bit of background. I had a PIP telephone assessment which they cancelled twice on the day, so on the third time I couldn't get anyone to be with me, but had notes and recorded it. Unsurprisingly I didn't get awarded pip. It took 3 calls to get the assessors report. When it finally arrived I was devastated it knocked my MH for 6 and I didn't eat for days, just cried and had suicidal thoughts and was so angry, like many I suppose. I am now a few weeks on and feel physically sick reading the report, but had to read it and I have listened to my recording. During the assessment which took 2 hours and 22 minutes, I ask her to repeat things 35 times as I have been diagnosed with complex hearing issues, but in the report she has reported that I had no difficulty hearing or understanding the assessor.

The report is full of lies and stuff I never even said that she has made up i.e that I said I only need help cutting up steak and baked potato, what I actually said was meat.
Another example she states she has a migraine and has taken her medication so her migraine is wearing off at present. I didn't have a migraine.
sorry to go on my questions are:

Can a previous tribunal award be used as evidence as they have used the previous PA4 and referred to it throughout, also does a tribunal award have a name like PA4 is the assessors report. I hope that makes sense.
My other question is, my sons is currently typing up the audio recording, but I'm not sure we will have it ready in time for the MR deadline, so do I not send it and save for the tribunal or ask for extension on MR and send it as this may save me having to go to court again.
Another question the assessor was asking me questions and giving me answers before I even had chance to speak, as well as asking me questions and then me part answering and then forgetting the question. When I ask her what was the question she said a different question, so the original question is not fully answered. Are these type of questions allowed?

I'm sorry that you have had such a poor experience and are now facing an MR.

The DWP will not look at the transcription of your recording at this stage, because it was a covert recording. However, the contents are still useful to you and counteract the key points of the report ant are inaccurate.

It's tempting to argue every single point, but what you need to concentrate on is the questions where you expected to score points and you didn't. Make sure that you read our guide on putting in an MR. At the end of your MR, you can always put in a final paragraph putting in the points such as MR - which makes you question the quality of the assessor.

I would also question the length of the assessment when you have hearing problems. This would have been extremely tiring for you and I would argue could have set you at a disadvantage.

Yes, you can use the previous tribunal award. I don't know whether you asked for the statement of reasons from your previous report or got a recording of that. It doesn't have a number attached to it.

Assessors often ask half questions, or questions that seemed to be the same question in a different way. This is common practice, but annoying. Some don't always wait for an answer which is poor practice. Again you can complain about this, but don't spend a lot of time on it. It won't make a difference to your PIP claim.

You could also think about putting in a complaint about your assessment. Doing so will have no impact on the MR as it is dealt with separately. Some of our members have been successful in having their complaints upheld.

Thank you, Yes I have your MR Guide. No I didn't get a statement of reasons just have the award notice from the courts. I may do a complaint, but in the past when i have complained I have had no response.

Hi, I don't know if this is much help, but if you go to otter.ai and make a free account, it will record words and type them up for you.

The phone app is very useful for making the recording, too (only up to 40 minutes).
But as you already have a recording, a free account lets you upload up to three recordings. It types it up as best it can.

If you then click on edit, and highlight anything it's got wrong, it'll play you that bit of the recording for you to correct. It keeps the transcript and the recording for you, and you can also download the text copy as 'your notes'.
It's certainly quicker than transcribing a recording from scratch.

I have painful wrists from a high keyboarding job,so I call it an aid to note-taking.
