Can I reapply for ESA? was created by aoifebrown
My ESA was stopped in April as my husband started to earn above the threshold. I do 1 or 2 hours self-employed work a week and had previously been in the support group. Now since the ESA stopped and my husbands WTC was reassessed, it has gone down to zero. My child tax credit has been much reduced also to reduce the overpayment of WTC for the year.
I get PIP standard daily living.
Our income has been reduced hugely now and I am not sure how we can survive. Is it possible to reapply for some benefit now? My husband works 22 hours a week. He cares for me but does not claim carers allowance.
Our rent is very expensive as we live in the south and we have just had a rent increase to top it off. Housing benefit is staying the same for now but I don't understand why. I informed them of ESA being stopped but the new HB calculation ( 35 pages!!) says please inform us if your ESA stops on the last page.
HB had said that the ESA claim was still open despite the payments having been stopped. Is this so my NI payments are still made? Do you think this is a mistake and the HB will be drastically reduced too? If so, how on earth do we pay our rent? I feel like as everything has either stopped or been reduced, we are in a completely different situation than we were in when first assessed by ESA as earning too much.
Also, should there have been some disability element added to the tax credits calculations? I cant see any evidence of that.
Please help..my brain hurts so much from trying to work it all out. Thanks

Hi Artpilgrim

Your questions are outside the remit of the forum. You do need to seek specialist advice from a Welfare Rights Organisation as they will be able to take into consideration all your circumstances unfortunately on the forum this is something we cannot do, we can only give general advice, not specific advice as we do not know all the circumstances.

One question I would ask is, you say your ESA was stopped, what type of ESA were you receiving, IR ESA or CB ESA?

You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies.
