Hello
So far, have had a good experience with the CHDA in my application for LCWRA.
The Customer Services Manager has been liaising with me, granted me two extensions, and allowed me to email her my form and supporting evidence as I cannot leave the house just now.
I received this note back from them on 22nd July:
"Following the review of your application and the additional information you recently provided, the Healthcare Professional has confirmed that an Assessment is not required on this occasion.
A report has been completed and forwarded to the DWP for consideration of a Decision Maker. They will contact you with their decision in due course."
Is that good news? I'm assuming it is, but don't wish to count any kind of poultry...
I've no idea how long this process even takes - I imagine that's a bit of a 'how long is a piece of string?' question - but in people's experience, should I hear about a decision within a month, do you think - or does it take longer than that?
Thank you,
Raph

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Raph
It sounds as if it is good news in that you don't have to have a telephone assessment. I would always err on the side of caution until you get the decision letter.
How long will the process take? Probably about eight weeks, but it could be longer and it could be quicker. At the current time, it's impossible to give a definitive time frame.

Update:
Have been awarded LCWRA of £343.63, which was paid on 2nd September.
A new challenge I have is I'm not sure why, but I've not received payments backdated to my original claim date of 21st April... It seems the Sept onwards payment is all I've been awarded?
I think it might just be a clerical error - as I had to switch from the original paper-based assessment to a digital one, and somehow I think it's possible that the two things have simply not been joined up...
But then...they haven't even dated the payments from receipt of my digital application - as that was 13th July.
I've asked this question via my Journal, but the response I've received is this:
Which suggests they haven't even read the question I asked. ʕ ͡° ʖ̯ ͡°ʔ
<<Le grand sigh>>
I've no idea what "contact ESA" even means. Who? On what number?
I thought as ESA was part of UC (?) they would be the people to ask.
I spent an hour in a PIP queue this morning waiting to get info about my PIP claim and thought I'd ask them too, but they also told me to put the update about LCWRA in my UC Journal, so I've reay no idea what, how, or to whom I should be highlighting this.
It's not a sanction (I don't think). I'm not appealing. I've not been turned down.
I think it might just be a clerical error due to lack of that wonderful phrase "joined-up thinking".
So is this a mandatory reconsideration?
And if so, what should I say?
Thanks,
Raph

The LCWRA decision is in relation to the work capability assessment that you had. There is no back payment as a result of the decision.
You will need to contact ESA if you have any queries about your ESA claim.
Thank you

Hi Ralph
You have posted your query twice, so I have deleted your second post as it is exactly the same as your first post just in case you are wondering where it has gone.
When a UC claimant reports to the DWP that they have a health condition that limits their capability for work this would normally trigger a ‘Work Capability Assessment’ (usually this involves the claimant completing a questionnaire and attending a medical).
If they are found to have (or can be treated as having) a limited capability for work and work related activities, then the LCWRA Element should be included in the first Monthly Assessment Period after the end of their ‘relevant period’.
The ‘relevant period’ is a 3 month period which starts when the claimant first provides medical evidence to the DWP (including self-certification). The DWP should then take the claimant through the Work Capability Assessment (WCA).
Although the WCA process often takes longer than 3 months, the LCWRA Element should nonetheless be included in the claimant’s UC award from the first Monthly Assessment Period after the end of their ‘relevant period’ regardless of how long the process has taken and even if the claimant goes to appeal.
The good news is that because this will often be due to a DWP error, there is no time limit to challenge the mistake and get it fixed. You may want to contact your local Welfare Rights Organisation for help, you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
