Hi

I was hoping someone could help me. I got an email from Benefits&Work talking about the LEAP review of P.I.P for mobility issues on Mental Health Grounds and that it seemed to be ending.

I had applied for P.I.P end of 2017 for both Mobility and Care. I got enhanced care till end of 2021 but was refused for Mobility. I decided not to appeal that as I was relieved to get care and people told me if I appealed there was a chance I'd lose the care. I was applying for mobility due to my physical conditions as well as my mental distress and inability to travel alone/leave house alone/cross the road without help which now in 2021 I am waiting for an Autism and ADHD diagnosis which might explain it.

In early 2019 my physical conditions deteriorated more and I applied for a Blue Badge from my local council who granted it till 2022 after an investigation and despite not having P.I.P mobility.

End of 2019 I received a letter from DWP about my P.I.P saying about changes in the law and that claims were being reviewed and that they looked at my claim again but that it was not affected by these changes in law etc. It said if I think I am effected by these changes to contact them. At that point I just believed them and didn't do anything as I figured why contact them when they said I wasn't affected and also the worry that it would effect my P.I.P Care component.

Also I had planned that when my review came up in 2021 I would try again for Mobility since I had a Blue Badge and also as my conditions are getting worse/new conditions discovered etc. However I received a letter this year saying my review has been moved to the end of 2022 due to the pandemic.

I am wondering if anyone has any advice on what I could/should do? I am presuming since it was 2019 that I received the letter that it's too late for me to do anything about this? Is there any chance of me fighting it and getting mobility backdated from 2017? Or is that completely gone.

Should I try for Mobility P.I.P with DWP now or should I wait for my review next year. I am reticent to do much as I've just moved local authority areas which has triggered my change from legacy benefits to Universal Credit which I am still waiting an award for.

Hello Minjaz and welcome to the forum.

You are unfortunately right about it being too late to challenge the decision that you current award was not effected by the Leap Review. Whilst ideally you should do so within a month, the absolute limit is 13 months, and you are clearly now outside that time frame.

Only you can decide whether or not to go for an early review of your PIP. You know how the hassle and stress might impact on you whilst you are in the middle of settling in after a move.

If you ask for a review, they will reconsider your entire claim, not just the mobility component, so there is always a risk. However, if you have read our pages you will know that there is an appeal process, and if you have lots of evidence to show that your underlying condition is no better than it was then you stand a good chance of being successful if you do have to appeal.

I have to warn you that although there I would include on any PIP form that you hold a blue badge, this is not a passport to a PIP mobility award. They are assessed on difference criteria, and by different agencies.

I would suggest that you look at our PIP guide, PIP resources , first link. See how the different activities are scored and try to give yourself a very honest assessment. If you think you should be awarded mobility then consider applying for a review.

Would you mind explaining what you mean by your statment below as it doesn;t make sense to me , sorry :(

Do you mean you would include it or not?

I undestand the bit about the different criteria etc, it probably makes perfect sense but I cn't get my head around it lol.

Hi Tracey. I would include whatever information you put in for your Blue Badge claim. Also get a copy of your GP notes and look through those, and include any that are relevant.

Hi traceytracey,
If you receive at least standard rate mobility PIP by virtue of 8 points+ under descriptor 2 (moving around) or either 10 or 12 points in the Planning Journeys section. (10 points England/NIreland - or 12 points Scotland/Wales) you can get a Blue Badge by ticking the 'I get PIP Mobility' box on the application form, paying the fee, and sending in the form (or using the online version.)
If the existence of one benefit, or a certain condition allows you to receive another benefit, or here a Blue badge, it is called 'passporting'.

If you don't have PIP Mobility as required, but you still have difficulties with moving around, including planning/following journeys or an upper body disability prevents you from using a parking machine, then you can still apply for a Blue Badge, but you would need to answer all the questions on the form (which is quite lengthy!) in order to show that you have the relevant disability that entitles you to a Blue Badge.

Whilst PIP Mobility can passport a Blue Badge, having a Blue Badge doesn't mean you will automatically get PIP mobility. There is considerable overlap, but the tests are not quite the same. Depending on the reason for applying for a Blue Badge, the fact that you have been awarded it, by the local council, will show that it has been accepted that you have a significant level of mobility disability which no doubt will help convince DWP when determining a PIP award.
I hope this clarifies about the Blue Badge scheme.

Hey, hope you are well!

I agree with Catherine, by all means submit this information with your application,

However it is a different department that deals with blue badges ( usually local council, nothing to do with PIP)

It may or may not help you, or totally disregarded, it is not on their remit, however, the more evidence you send the better.
