Once again I have been refused mobility despite evidence supplied of PTSD and anxiety which prevent me being able to plan and follow journeys. Should I ask for an MR or am I unlikely to succeed ?

It is impossible for us to answer this question without knowing a lot of information about how your PTSD impacts on your ability to travel. Some people with PTSD are awarded a mobility element, so on that basis there is arguably nothing to lose by requesting an MR.

You say that 'once again' you have been refused which makes me wonder if perhaps you are not presenting your case as well as you could. It might be worth approaching a local advisor to see if they can help you, or even a good freind who will look at what you have put and see if it fully reflects your reality.

I would just add that whilst not everyone is successful at MR or even at Appeal, many people do fight on and eventually get the correct award.

Thank you for your support Catherine. I have used your guides for many years and been encouraged by other people’s success stories but I find the almost inevitable argument with the DWP so exhausting. I finally won an award of standard living and mobility in 2016 by getting a letter from my MP because the Capita report was just SO wrong and the AO had not requested any supporting evidence, but at that time the AO recorded my physical health condition as primary and my mental health condition as secondary despite my insisting they were linked.
It seems that my anxiety and PTSD have been constantly overlooked and the most recent letter states that I have left it too late to ask for a reconsideration but I have kept all the notes and correspondance and wonder if it is worth requesting an MR even now.

Hi Christie T,

You have an absolute right to request a MR within a month of the original decision. After that there is a period of twelve months when you can still request one, if there is a good reason why you did not request it during the original month. The further into the twelve months you are, the better the reason has to be. At the end of that period, I.e. 13 months after the original decision there is an absolute cut off for an MR.
