Hi.
In 2019 i was awarded pip enhanced daily living but no points and no rate for mobility.
After unsuccessful mandatory reconsideration i appealed to tribunal for a mobility award.
As i was happy with the care part of the award the tribunal only looked at the mobility part and i was awarded standard rate mobility by the tribunal.
My tribunal decision letter dated may 2019 states that i am entitled to pip enhanced daily living and pip standard mobility until may 2022.
i have recently received another pip review award form 1043 which i have to return within a couple of weeks. 8 months before my current award is due to end.
my questions are
Is this the right form that they have sent me for completing (or should it be the pip2 questionnaire)? As part of my award (mobility) was decided by the tribunal
and
If after sending this pip review form back, they decide to reduce or take away my current award, will i still continue to be entitled to it until may 2022 and for another 8 months, as per the tribunal letter, or will my payments be reduced or stopped straight away?

Hi Peejay
Review forms can be sent out up to 12 months before the end of an award. This gives plenty of time to process them. So 8 months before is fine.
Whatever award you are given after the review will be the one that stands from the decision date of the award letter going forward.
They have been sending PIP2 for most decisions made at Tribunal, but you may have been lucky because only one part was decided by the Tribunal. If you'd had the PIP2 you would have had to reapply for your whole PIP claim.
When you put in the PIP review form, include a copy of the Tribunal decision.
BIS

Thanks for your reply. You have made things clearer for me.
Yes. Receiving this pip review form to fill in instead of the pip2 and having to go through the whole long winded process of reapplying for the whole pip claim all over again.
And yes, i do have a copy of the tribunal decision and will make sure that i include it in with the pip review form when i send it back.

Iv been going through kinda the same with dwp with regards to tribunal decision and what should happen after and after a lot of research have found they shouldn’t of sent you a review form 8 months before they should send you a new claim form 14 weeks before your tribunal decision ends as there has been a lot of upper tribunal cases about this. Because being treated as a review form and what I have found from personal experience is they will go along with your original award that was decided by the dwp and there for in my case they slashed my payments in half. I’m only guessing but is your pip due to mental health? Mine is and it has happened a lot. I also sent in my tribunal award and guess what it was ignored and not even mentioned. I don’t know how it stands with your care component but they can only change the mobility component if they think it was awarded on an error in law. You asked for a change of circumstances or they received new medical evidence and by medical evidence they can’t say you had another medical assessment and new medical evidence came to light because that hcp is giving an opinion and unless they have actual new hard evidence which in my case they didn’t I sent them the same stuff I sent them before I won the tribunal nothing new just my tribunal award but some how the hcp and the dwp came to a different and more to the point in there favour to award me less money. I’m currently fighting all this with the dwp. And what they are doing is called superseding an award and unless they have either one of them 3 things Iv said about legally they cannot do that. What they are doing has been going on for years and it’s disgusting.

Hi
I have another query please.
I am trying to complete my pip review form and on the last question 12 moving around.
At tribunal i was awarded 10 points for being unable to follow an unfamiliar journey without another person because of my mental health condition.
But i also have physical disabilities that impair and restrict my walking and i have to take pain relief medication.
From the last assessor's report, she has written that my painkilling regime is not consistent and that I do not take painkilling medication before walking?
I take pain relief after the affects of walking, but not always beforehand, because i am not sure when i am going to go out and leave the house. (does that make sense)
Anyway, im not quite sure what to write down and answer for this question?

You need to show that your painkilling regime is consistent, are your painkillers prescribed? if they are and you follow the prescription then you can show that it is consistent.
