Universal credit and disability premiums. was created by Filey
Hi, I've recently had to claim universal credit after my sons pip was stopped, which I am currently taking to the tribunal. Previously I was claiming income support and was in reciept of both the disability premium and severe disability premium. I read online that you cannot be worse off when you claim universal credit but I am worse off , as I have a shortfall of £152.00! Can any one advise me please? I've asked in my online journal with universal credit about this. I am also having to pay more rent with universal credit than I did with income support. My anxiety is through the roof with it! Thank you.

Hi Filey
What you read online only applies if DWP ask you to apply for UC, it is called transitional protection; it will not apply if you have to apply for UC due to Income Support stopping, this is called Natural Migration, you can also Voluntary Migrate to UC, once you apply for UC you cannot go back.
You should still be able to claim the housing element but as your sons PIP has stopped then this will have an adverse effect on things such as non dependants.
I would advise you to seek help from your local Welfare Rights Organisation; advicelocal.uk

OK. Thank you for the advice. My son doesn't live at home. I live alone. Does this still apply? Debbie.

Hi Filey
If your son does not live at home then you will not be affected by non dependant deductions.
This is why we always advise members to see their local Welfare Rights Organisation, who will be able to take all their circumstances into consideration when giving advice.
We can only give information as we do not know all the circumstances to give advice.

Hi, thanks for replying. I was on income support and I was getting both disability premiums, severe and standard. When his pip stopped do did my income support and I had to claim UC. I had to wait 5 weeks for payment but have only been paid for 4 weeks and I have not been paid the same amount that I was receiving on income support. Is this correct do you know? Thanks again.

Your latest post suggests that there was a gap between your IS ending and a claim for UC being made, if this is the case then I'm afraid that UC will take no notice of what you were receiving under IS.
However, if the PIP appeal is successful then the reason that the IS was stopped will be removed, I assume you were a carer and it will go back into payment for the period covering the PIP Decision Date to the date you claimed UC and this should then allow an additional payment in your UC for the SD Premium but it will not be as much as you were originally receiving. You still will not receive any payment for the Disability Premium but could apply to be assessed for the LCWRA element of UC.
