Adult Disability Payment not Back dated

Hi,

I recently just received my ADP determination but it wasn't backdated as far as I expected. I submitted my Part 1 application online of 25th February. Part 2 was due to be submitted 8 weeks later on 22nd April. I was still waiting on my GP records & completing the form so I called up on 17th April & received a 2 week extension with no issues. I submitted Part 2 & the medical evidence on 25th April, 3 days after the initial deadline but well within the 2 week extension. My claim was only backdated to 25th April. Is this correct? I thought that as the extension was approved within the timeframe it would be backdated to the Part 1 date as expected.

I should add the I read the delays in ADP were largely because applicants were not collecting their own supporting information, the decision was made within 4 months & not the expected 6 months & my GP was on holiday for 2 weeks which did not help as nobody else can release the records.

Would I have grounds to submit a re-determination on this basis?

I appreciate any help in advance, thanks.

Hi Dee Emm

I'm sorry, but I don't know what the rules are for ADP - you will have to ask. I would expect it to be backdated to around the time they had all the information and the decision was made - but I may be wrong. You have nothing to lose by asking them and see whether it is an error.

If your application is successful, the earliest date that Social Security Scotland can pay you from is when you:

submitted the first part of your application, if you applied online

phoned Social Security Scotland to start the application process, if you applied by phone and paper form

Would suggest you contact Social Security Scotland and either raise a complaint or request a redetrmination through an organisation like your local Citizen Advice Bureau who are to speed with ADP rules

Is there any reason why the Decision Maker could assume that you have not been suffering from your current limitations for at least three months?

ADP require you to have had those limitations for at least three months and that it can be reasonably assumed that you will have them for a further nine months before an award can be made.

Thank you so much for the replies everyone. I actually got it wrong, I was awarded standard mobility & enhanced daily living from 25th February so please disregard my previous post.
