Assessor report full of errors was created by Yorkiegal73
I've received the report. The decision maker hasn't acted yet.
It gives me 8 points care, 4 points mobility.
I'm currently on enhanced for both.
Last face to face assessment received enhanced care only.
Paper review during covid added enhanced mobility.
This latest was phone call. Meant to be video. Previous claims on mental health only, this one added long covid.
Assessor was rgn with no mental health experience.
Tons of omissions. Claims that I didn't sound in pain when she must have heard me. Saying that I told her I wasn't a risk to others when out, when I told her the opposite and that cpn previously reported to police that I am.
The main problem is that I no longer have care other than gp but I explained how I have no trust in community mental health team, that long covid clinic won't accept me due to mental health and that I've taken advantage of post covid changes to avoid the gp by having online and phone consultations. Avoiding authorities is all part of my condition.
Also went against me that I had no help for assessment. This was planned but let down at last minute and I was fearful of losing claim.
Apparently I also didn't sound depressed.
So, do I wait and go for mandatory reconsideration? Or is there any point in informing dwp of the errors now? Could I even ask that decision maker hold off for a few weeks so I can write to them with all the detail?
Also can I still request a copy of the previous paper review where they put me up to enhanced?
Thanks

Hi Yorkiegal,
My report from the accessor also was full of errors, and it ended up costing me my PIP. I did get it back eventually after fighting it, but you can see via this link, just what I experienced, and it sounds similar to yours.

It's up to you personally what you decide, but if you feel that there's an injustice, then you can fight it.
The guides on this website are brilliant for helping you word things correctly.
Regards, Chris.

Hi Yorkiegal
I'm sorry that you find yourself in this position. If you want to write to the decision maker - you can do so. You can always use the same information in a Mandatory Reconsideration if it turns out that you have lost your enhanced award. The decision maker will not hold up the process - either you get a letter in very quickly or you wait and put in all your effort to an MR.
I know it's infuriating when you get a report that is full of omissions and errors, and you want to tear the whole thing apart. As hard as it may be, put most of the effort into the questions - and where the assessor has downgraded your score. Keep any general complaints to a final paragraph at the end of the letter - e.g.. The assessor didn't think you sounded as if you were in pain. Itt's a stupid comment on their part, but it won't in itself score you more points. Point to the evidence you have already given on your form, your medication and what you were experiencing during the assessment. Just say the assessor was 'mistaken in their belief you were not in pain.' As for the idiotic remark about you didn't 'sound depressed'. This person does not know you, did not see you and would have no idea what you would sound like. There is not medical definition for what a depressed person sounds like. Some can hardly talk and some could go and give a lecture to 2000 people with no problem. I despair that these are the people making judgements.
You are like many others with mental health conditions without current support. That should not be held against you. The system is woefully inadequate as it is, and in most areas they are giving people a limited amount of time and then discharging them. I understand your lack of trust in the system. Emphasize this in your response.
Come back if you have any further questions and we will try and help

Hi, your story is nearly identical to my son's. He doesn't engage due to lack of trust and his mental health conditions and they tried to use that against him. Took away his enhanced mobility using the exact same technique....an inaccurate report full of omissions, none fact and even out right lies. Totally blanked my supporting evidence!
As my son's appointee and carer I complained to the assessment provider IAS and the DWP. HP is now in alot of trouble for lying about speaking to my son (she spoke to me only), and for failing to gather sufficient evidence etc etc.. DWP are in as much trouble as the decision maker did the same thing, went with a flawed report even after I called and wrote to them well before the decision to say the report was flawed and that it was under investigation by the provider but the DM took zero notice which is against guidance.
I requested a MR and the assessment provider sent in new advice from a clinical medical advisor. Success! 👍
Don't let them get away with it!

Thankyou. I simply can't bring myself to go through the report right now because just reading it has caused a crash in my mental health and a big flare up of joint pain from the long covid. I'm going to give it a few days then tackle it with my friend.
I didn't send in any evidence and I was too poorly to fill out the form properly when it came over a year ago so I did actually ask for an assessment. I suppose I might have to go see the gp, which I hate because it's a huge practice and there's no continuity of care. They don't even notice when I get too poorly to order my meds so they certainly don't understand my day to day issues. I'm very lucky to have a close friend who helps me but she's also on pip and scared of giving me a supporting letter incase it affects her claim
