Old dwp decisions as evidence was created by Chocolady
Can you use past dwp decisions as evidence for esa claims? Ive recently found an old decision letter where the health professional says they recommend support group as Ive got severe functional disability and my condition is unlikely to improve in the longer term although theyve said work is unlikely for 2 years. Ive got my telephone assessment coming up and I didnt include this when I sent my ESA50 form back in but Im just anticipating in case an MR is needed or i need to go to tribunal. Im also wondering if i should be having a re assessment under the circumstances with those findings in the report even though it was a few years ago but not sure. My conditions have got worse and I have developed a few more since that report.

Hi Chocolady,
I believe most evidence when written down can be used if it helps you. I have done this in the past with my claims, and highlighted things that have been written by the assessor to get a point across.
Maybe other claimants or more experienced mods can elaborate further ?

Hi choco,
In my experience, I've just answered the questions to the best of my ability when having my assessment. I submit additional evidence at the MR and/or tribunal stage.
Just try judge best you can when on the phone, and see if anything that you're asked, may be worth mentioning from the additional evidence that you've got.

Yeah i keep feeling panicked and then think its all I can do is my best. Just one more quick question if it’s a telephone assessment can they ask for it to be a video call? Im not planning on getting dressed out of my PJs (too much info) as theyve said they could ring at 9 and I dont normally manage to dress before ive mobilised later in the day unless I have help and it’s a good day. It’s bad enough dealing with this first thing as it is. Just dont want them to ask for a video call half way through or something.

Hi Choco,
Not that I'm aware of. A telephone one is where they speak into your ear, rather than face to face. You should've been warned though that the calls can be half hour either side. So if your appt is at 9am, then be ready 8.30-9.30am for the call, then obviously the length of the assessment after that. Usually the 9am appts are the first ones they deal with. Mine called me at 8.47am.
