What to do next please ? Help after losing my enhanced living pip after f2f lies

Hi,to the forum ,I am not newbie and have been member since 2019 and lurker/stalker on here ever since,my question is for some help at my review award.i have been awarded my mobility enhanced but awarded nothing for my daily care ,I am upset at the way the report has been handled falsely and incorrectly,I asked for the report from the f2f over 2weeks ago but nothing has been sent ,next question is for help what to do now to appeal this,I have already lost £50 a week when migrating from income support to up,another kick in the teeth when I am struggling day to day tia

Welcome to the forum, even if you have been a member since 2019.

The first thing you need to do is get hold of the assessors report called a PA4, if it has not yet arrived phone DWP again and request another copy. We have had members who have reported contact three times before they received a copy.

When you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will now be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say 'in my opinion' you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said, remember they are just an opinion which is not based on fact.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation.

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide; benefitsandwork.co.uk/guides-for-claimants/pip

When completing the form, state that you are not arguing about the mobility component, you are arguing about the daily living component due to the following reasons;

I thought the assessers report was PA3 this is what i got in my bundle ready for my tribunal next week

Dear fivriver, just a rider to Gary's sound advice. If your one-month-from-the-decision is nearly up because of the delay getting your PA4, do not miss that deadline and have to argue over that too; you can put in an MR [Mandatory Reconsideration] now in which you state that despite requests they have not supplied the PA4 and so you WILL be sending in additional information in support of your MR.
Then do that as soon as you have seen the PA4. Never say they 'lied', it gets their backs up. 'Appear to have overlooked', 'misunderstood' etc. As well as politely taking apart the PA4 [concentrate on the points-losing bits, not the whole pile of junk] , you might want to add eg an NHS page about your condition or your meds that they have got wrong in the report.
(example was they said daughter's Tramadol was for moderate pain. sent in NHS page on Tramadol showing it is for severe pain).

Hope that's of some help, don't forget getting in before that deadline.

These PA3's and PA4's get me also, but from what I understand online -

a)PA4 (PIP Assessment Report)
b) PA3 (PIP Paper Based Assessment Report)

Hi Gary,thank you for your input.i have now received my assessor’s report and feel like I been totally misled and misreported, I am upset at this and need some help in correcting these opinions of Hp ,these are not facts of my situation,hoe can I receive some help please.thanks
