ESA to UC Migration was created by CAP
I'm currently filling out my UC application being as i'm in receipt of ESA and have to get my wife to also fill out an application as well being as we obviously live together , but I'm a little unsure about part of it for my wife as she wasn't claiming ESA and once I've ticked that box for her it says that she will have to submit fit notes and may have to attend an assessment. Unfortunately she has stage 4 cancer which has been written within her health conditions part of the form,so is she really going to have to submit fit notes and have an assessment? I have also ticked the section where it asks if a specialist thinks she has less than 12 months to live which she was told that 14 months ago although the cancer is still speading ,but she's still fighting it. I have ticked no to the question would she like them to ring her. Is the DWP going to show any compassion or is it a case of no fit note no UC even though it's me that is having to apply for UC because of my ESA?

Your wife will need to complete a claim for UC which is then joined to your claim.
The first question to ask is has your wife applied for PIP, have you been in contact with Macmillan Cancer Support and has a SR1 form been completed.
We would advise you to seek help from your local welfare rights for assistance with your joint UC claim.
Citizen Advice have a government contract to help claimants apply for UC.
Call their Help to Claim phone number
You can contact an adviser through their free Help to Claim phone service. Advisers are available 8am to 6pm, Monday to Friday:
England: 0800 144 8 444
Scotland: 0800 023 2581
Wales: 08000 241 220

Hi Gary,
Thanks for your reply. My wife is in receipt of PIP on the higher rate for both components, so whether that's taken into account for the UC claim I don't know I guess we'll have to wait and see.

PIP is not taken into account for UC, if your wife was not in receipt of ESA support or WRAG then she will need to provide a fit note or a SR1 form.

An update on the my UC claim to make people aware of is that supposedly any communication through the journal is only supposed to happen Monday - Friday and I logged in on a Saturday morning as I'd sent a message on the Thursday morning and hadn't had a reply ,but when I logged on ,somebody had replied on the Saturday morning but I hadn't received a text message telling me to check the journal which I thought was a little bit strange. I had to go for a face to face for an ID check and when I mentioned it to the person who I saw she was also confused as to why that had happened as she said you should always receive a text message telling you to check the journal,but that you shouldn't be receiving journal resposes on a Saturday. Then last Saturday afternoon I received a call from an 0800 number which normally I would ignore ,but decided to answer it and it was a call from a DWP decision maker which I'm glad I answered as things had been documented incorrectly at the face to face meeting and she was about to tell me that I wasn't entitled to UC,but once I clarified a few things then I was told that I would be entitled to it,but as of yet I don't know how much I'll be getting until later in the month.
Also my wife will not have to submit fit notes or an SR1 form which was also a surprise as we were expecting it to be one or the other.

Hi CAP,
Thanks for your update.
DWP management has the discretion to request staff to work at weekends at an overtime rate. So you may well get unexpected responses at weekends.
