Thanks David….i am not sure what you meant here. So I have a letter from recent that says I have had esa support group since 2011. No mention of a contribution element, says it is income related. Is that the sort of thing you mean?
I feel really worried that in the future they may do something because of this.
Does having this as a new claim pose a problem that you know of, for instance are new claims not allowed the substantial risk element of wca?

Yes keep all written evidence regarding your claim.
The DWP haven't made any announcements regarding " substantial risk ". If there are changes it will be reported in the New section of the BenefitsandWork website.

I got a call back today at nearly five pm. Very nice lady but said she would send it over to wca and that it could be because I am due an assessment. I said I should be in lcwra group because I am in support group and she said she didn’t,t really know what that was. The Lwcra group, said she didn’t know what it was.? Said she hadn’t really heard of it.? Those were her exact words.
I am really stressed. It feels really false, like they aren’t proper conversations I am having with them. What is going on?
I had to explain over and over that because I was in the support group I should be in the lcwra group, but she pretended to not know what it is, and said the lcw group is fine. It was about thirty minutes and I feel totally stressed out.
Why would they do that? Pretend to not know what the lwcra group is?

The UC element is called Limited Capability for Work Related Activity 'LCWRA' , if the lady did not know what you were talking about, ask to speak to their line manager as it is a training issue.
Yes you should be placed in the LCWRA group if you were in receipt of ESA support, providing there was no break in your claim.

I got a call today and it was explained that I had misinterpreted the letter. I still don’t quite understand, but she said not to worry. Also she said they had made a mistake in closing the claim and apologised. She was very understanding. I recorded the call. Thanks for all your help. I do think that the letters can be very hard to understand, and my brain freezes with it all. To be fair when it’s due, she took the time to explain it slowly, once she realised I really didn’t get it. Grateful for that. I still think we need a radical overhaul, like the start of the welfare state…universal basic income. Give us all a true chance to reach our potential. Let it be a gift to the future generations. If we can screw up so monumentally, as all the food banks demonstrate, then we can turn it round over time as well. Real change please.
