My sons Father died . I had divorced him. He was in receipt of a pension from the City of London. As he left two disabled sons they were awarded a Childs Disability Pension which is paid monthly. How is this treated for Benefits? We have always declared it but a query has arisen as one of my sons has recently had to claim ESA as he gave up his employment as it caused him to have a breakdown. He has already been offered a job. Is it treated as an inherited pension and need not be declared or should it be declared and therefore taken into account.

Firstly if the above is your email address it is best not to use it as a user name for internet security reasons.
Who is paying this pension? I assume it is an institution. How is it paid and what are the conditions and time limits?

It is not my email address but part of an old one. It is paid by the City of London. It is paid monthly and subject to tax. As far as I know it will be paid for ever. ? an inherited benefit. It was awarded because of the kids disabilities and would stop if they got better which is unlikely because they are life long conditions. Hope that helps

I sent a reply but it seems to have disappeared. This is not my email address but part of an old one I used years ago. The pension is paid by the City of London Pensions department. It is paid the last working day of every month and is taxable. It w as awarded because of the kids having life long disabilities. As far as I know it will not stop unless they recover which is not going to happen a they have life long conditions. Is it classed as an inherited benefit?

I have not dealt with the City of London previously. I understand it is not an ordinary Council but a Corporation.
Also am I right in assuming he is claiming New Style ESA ?

It appears so. He was asked to complete the migration form which we did. He was then paid two weeks CB ESA and then another payment of what we don't know. The initial payment is wrong too. he has ben on benefits since he was 16 and is now in his mid 40s. ,We have to try and get things right because it will effect his care charges that he has to pay to the local authority, It is a nightmare as many claimants are finding out
