Hi, Some questions on ADP, any help greatly appreciated.

Can you ask them to look at the length of the award again and not the level of awards given?

If you ask for a redetermination can they reduce the award you have already been given?

If you had an existing 10 year award which was reduced significantly do they have to give a reason for this if you report no actual changes in your condition/health?

ADP is so new and I don't live in Scotland - so I can only tell you what I think - not give you a definitive answer.

1. Yes, you can ask them to look at the length of the award only.

2. I assume that they could reduce the award after a redetermination, but in reality I think it will be like PIP and they are more likely just to leave it as it is if they refuse to up the award.

3. If your ten year award has been reduced 'significantly' it seems to imply that your health has improved and therefore you should be entitled to an explanation of why they think that. You will probably have to ask for the explanation if you haven't been given one.
