Hi,
I had a LCW mandatory reconsideration refusal, I am doing a appeal. They say I can no longer put in a fit note, unless it is for something new. If I put in a fit note for a new condition I have, can they refuse the appeal for the other condition I am appealing.?

Hi Zenzen,
No one can stop you getting a fitnote if your doctor is issuing one, however, they can refuse to accept it. This happened to me a few years back, and I declared the fitnote via a journal message regardless. I was/and still am in the LCW group also.
Also, your appeal after an MR will go to FtT, then UtT (if an error of law is found) - this is the stage I'm at for exactly the same. All your evidence can be added and sent to the courts, should you wish to do this.

Thanks for your reply, you didn’t answer what I asked though.
maybe I didn’t explain it properly.
What i’m asking,
they said I am fit for work so I can’t put in another fit note, unless it’s for something different. I am not on lCW, just U.C.
If I put in a fit note for a new health condition, but I still need to appeal for the MR rejection for the other condition, can they stop my appeal if I put in a new fit note for a new different condition?
Hope you understand what I mean.

They are two separate issues.
The appeal is ongoing and will progress to completion. They won't stop that even if you submit a new fit note.
You have a new condition, and therefore, you can put in a new fit note.

Ahh I understood you - sorry, I should've explained from my own personal experience, it depends on which DWP person replies - some would accept, and some would decline - that's why I couldn't answer it as well as BIS suggested. I'm still learning a lot from this website, so whilst some issues, I can help with, other's I'm not overly sure how to answer exact.
