Thank you, what does NSESA stand for please, and what is the timeframe for making an appeal about an ESA assessment decision? As you mention, 6 years is too long.

Hi,

This stands for New Style Employment and Support Allowance and in relation to the timeframe - please see the following information from the Gov website:

The general timeframe for appealing an ESA decision involves two key stages: mandatory reconsideration and tribunal appeal. You must usually request a mandatory reconsideration within one month of the date on the original ESA decision letter. If the mandatory reconsideration is unsuccessful, you can appeal to a tribunal, but you must do so within one month of receiving the mandatory reconsideration notice.
Mandatory Reconsideration:

Time Limit:
You generally have one calendar month from the date of the original ESA decision to request a mandatory reconsideration.
Late Request:
If you miss the one-month deadline, you can still request a mandatory reconsideration if it's within 13 months of the original decision date, but you'll need a good reason for the delay.
Example Reasons for Late Request:
These include being in hospital, dealing with a bereavement, or having an emergency.

Tribunal Appeal:

Time Limit:
You usually have one calendar month from the date on the mandatory reconsideration notice to submit your appeal to the tribunal.

Late Appeal:
If you miss the one-month deadline for the appeal, you can still submit it, but you'll need a valid reason for the delay, and the tribunal will decide if the appeal is accepted.
Exception:
The tribunal can extend the time limit, but usually not beyond 13 months from the original decision.
Exceptional Circumstances:
In truly exceptional cases, the tribunal may consider appeals even after the 13-month limit, but only if you've demonstrated you did everything you could to appeal on time.
