My Pip declined after telephone interview

I had been awarded Pip in 20 18 after my court appeal. I was awarded the highest rate for my conditions. I had cervical spine surgery that left me with perifial damage on my nerve bundles causing many disabilities from the life I had . I have cpds .
Since my award I have had further health issues struggle to manage and since then have been diagnosed with psoriatic arthritis that brings so many issues. I also was diagnosed with asthma and waiting for surgery on both hands with carple tunnel. I am very low in mood.
I had a letter fir review and had a call at 8.30 in the evening from the lady who did the assessment. I never get calls at this time unless it's a scam. I answered the call and said nothing because I was nervous living alone and 70. I rested talking and she said hello I'm calling about your assessment for Pip. I was overwhelmed and she said oh sorry I can tell you are nervous. She then said I'm checking that you can make the appointment wich was a few weeks away.
I said can I delay as I need help to get my doctors evidance foe the review, she said please don't worry as you have plenty points being on the high rate, so please don't worry about this. I followed her advise and we had the phone call and I said that my disabilities had got far worse and now I have many new issues. I told her that I needed help with support and had alterations made to my bungalow. I explained clearly as I had a list . She asked if I had holidays, did I drive ect.
She was getting upright with me as I was very nervous and said hurry up or we will do this another time and that My bennifit might stop. She totally sent me on a big down spiral. Finally got my letter telling me I scored 2 points for using an aid in the bathroom. I lost all of myself .
I'm struggling with such lies she only did a small report and it did not mention all the disabilities I told her about. I'm soon to be 71 and just think they do not want older claimants on Pip. All my evidance was shown 7 years ago and most of my conditions have got worse.
I need help so I asked CAB to help me. I struggle to fight this and have not got a great memory to do my reconsideration. I have asked my GP to verify what I told them is fact.
I'm tired and very low with it all.
I called dwp to say I was asking for a reconsideration. I am now waiting for my doctors , consultants proof but this may take weeks. Today I had a letter from Pip saying I had one month to send the evidance, so just hoping to let them reconsider. I had 32 points at 67 years old and now only two points.
Life is tuff one might say.
My son comes to support when he can after work and I have a young couple of neighbours that also have helped me, I can no longer pay fir help as on very little money . My son is helping me to send this post as my hands , fingers will not perform.

I am so sorry this has happened to you. I know it's probably the last thing you want to do - but I think with the help of your son, you should put in a formal complaint. You did not even know you had an assessment and that was atrocious. I think you have been deceived and you were entitled to have 7 days notice. There is no way that you should have been contacted out of the blue like that. This complaint should go to the DWP and also to whichever service assessed you.

You do have to put in your MR within a month - but you can put in it that you will be sending in further information - like a letter from your doctor. I would also put in that MR that you are putting in a formal complaint (if you do one).

I know your mood has dropped - but please hang in there. I hope with support from the people around you - you can fight this.

You need to get your PIP back.

Thank you for your advice.
I have been struggling to navigate this platform so only just seen this.
I need guidance . If I send the form back saying I disagree do I have to to include medical evidance at the same time? I have asked for my doctors notes and will take a month. I did call them and said I needed help from cab and the form would be after the one month. I now have everything typed out and can send to them. So shall I say I'm still waiting for my medical evidance and send later. I really am struggling to understand. Also they had all the evidance that actually has become worse now I'm in my 70s. Im not sure if
I need to show all this again? .Iwill post recorded. Any advice much appreciated. . Thank you

Your Mandatory Reconsideration has to be submitted within one month of the date on your decision letter. Try not to send it in late - you don't want them to reject it because it's late.

If you are still waiting for a letter from your doctor, put on your MR a heading "Evidence to come" and say "Letter from GP - Expect to submit (date)"

You don't need to send any evidence that you have already submitted. If you particularly want them to relook at something - just put what it is eg letter, report etc and then say "previously submitted (date),"

Thank you Biz. My update. Yesterday I had my appointment follow up at rumatoligy for my psoriatic arthritis and and my consultant was very clear about how I am declining with my condition and could see very clearly my hands and foot that cause difficulties with walking and using my hands to do things. My scan for bone density shows thinking of my bones in my spine and hips. I explained that I was declined my pip and mentioned I only got 2 points. He was appalled and is doing me a letter with his findings and how this effects my being able to manage daily life. I was so pleased he will do this to help me. I am waiting for it to come to me.
Also since my first claim I was diagnosed with copd initially by my he doctor and since going on an inhaler now registered as asmah since using the medication. Should I ask my doctor for a letter about this also.
Getting back to the reconsideration. I did make the call in time and got a text to confirm I did it. I told dwp that I was getting help from cab and they could not do it within the month and also I wanted to get my evidanc of my conditions . Subject to acces takes a few more weeks to arrive, so I am wondering should I hold onto the form they dis for me until all this information arrives? The thing I am confused about is I did not score any points on historical evidance that I submitted back in 2020 at my tribunal, so when you say you do not need to resubmit again, why did I not get any points. So I am still not sure if they need all what they had before. Am I right in thinking I am OK to hold the letter back until I get further evidance. Sorry I'm finding it all hard to understand.They surly can't say I'm out of time. They tell such lies it's a massive unpack on my mental health and such a struggle now I can't pay people that do jobs fir me like shopping a cooking, cleaning, changing my bed all things I need help with, they cost money.

I would not of got my pip before without help from this group and help from a friend and family who came to the tribunal.

From what you've said, it seems you have informed the DWP that you want to submit an MR but can't meet the one-month deadline for completing your Mandatory Reconsideration, because you haven't got all your evidence.

Normally, claimants have to send in the MR (not just a notification) within one month, including a sentence about any late information they want to submit with an approximate time of when they will send it in.

What's unclear to me is whether you have sent in your MR explaining why you are challenging your award or whether you have informed them this is what you want to do. It's not clear whether you have permission to send it in late or you have informed them on the basis that you think that's okay.

Now it may be I have misunderstood what you've said. If you have spoken to someone at the DWP and they are happy for you to send in your MR and any additional evidence - late - that is fine (and hopefully you have a record of the date you spoke to them.).
If you haven't had someone say that is okay - then I would phone them to ask how long you have. It's great that you have support from your GP and the consultant - but the DWP will process your MR to their deadline - not anyone else's and they are quite happy to proceed before they receive people's information.

So if you have been told by the DWP that you can send in your information late, you don't need to do anything. If you were not explicitly told by someone that you can send it in late - then I would advise you to ring them - just to check how long you have.

The DWP has your previous evidence on record - even if they ignored it. They ask you not to send it again - and that's why I said refer to it. But if you don't trust them to look at it and you feel you want to send it again - that is your choice.
