Hi, has anyone else experienced this? My heart is pounding through my chest. I am unable to cope or manage DWP stuff due to the harm they cause me. I have previously posted on a post: 'are they treating me badly...'?

DWP will not accept my managed migration ESA Support Group. I gave them the suggested text from the guides on this website (thank you). Two months ago, they even replied to my MP in a complaint response that my Support Group status was transferred and confirmed I would not have to have an assessment.

But now they have changed their minds. They are still not responding to any of my messages. Just posting new ones of their own that I have to respond to immediately.

The latest is that if I do not provide a fit note, they will treat me as capable of work straightaway. I have been in the Support Group for over 10 years. They will end up killing me? I don't know what to do.

They are victimising me :'(

Please can anyone help?

My MP can't help anymore because it's "not in our remit". Help to Claim have advised DWP direct with my needs but DWP ignored the advice. Safeguarding advice that DWP requested themselves has also been ignored.

I am literally on my own with a law-breaking institution.

Thank you x

Hi JusticeYogi

In your previous post you said "Sorry, I forgot this. In the complaint response to the MP, (all untruths aside) they stated this: "I can confirm [my name] ESA IR decision has transferred to her UC award and she does not need to attend a further Work Capability Assessment."

Can you please submit in full the replies from your MP?

David

Dear [Justice Yogi]

Thank you for your recent emails following our telephone conversation late Friday afternoon.

Given your distress on Friday and your request when we spoke to get back to DWP urgently, I emailed them again to ask for clarification re. concrete next steps to help move your case forward. I am sorry you didn’t feel my response to DWP was adequate; so it might be helpful to clarify expectations in terms of where we and how [redacted MP's] office can support. As caseworkers we can support you with the administrative process but are not here to challenge DWP policy. There are, as you are already aware, formal channels through which to do this.

Regarding identity verification, this will need to be resolved directly between you and DWP. If you would like to continue with your case and receive payment, DWP will require this verification. Unfortunately, [redacted MP] is not able to verify the identity of any constituent in this context.

I hope this is helpful to inform how you want to progress.

Kind regards,
[redacted] (Caseworker)

To clarify above and response to DWP being "inadequate", this is due to the misrepresentation of what we discussed. Their office, openly admitted they didn't understand the benefits system, told DWP I just needed clarification about the ID process, which was not correct at all.

I contacted them again in November and asked for surgery appt to discuss. Reply below:

Dear [Justice Yogi],

Thank you for your email, and I’m sorry that this is causing you so much distress.

As [redacted MP's] casework team has already provided support regarding your DWP case and taken all available actions within our remit, I’m afraid we are unable to offer any further assistance on this particular matter.

However, if you receive any new information or developments related to your case, please don’t hesitate to get in touch—we’ll be happy to review it.

Best wishes,
[redacted]

Office Manager
[redacted] MP

Due to how I am being treated repeatedly illegally, I have outlined my case directly to directors at DWP. I received a response almost immediately and they said they have forwarded to the 'operational team to resolve'.

But today I have been sent an 'overpayment' letter that will be taken taken from my payments, apparently, even though I have not received any payment from them at all.

They will not respond to ANY of my enquiries about the WCA and the Support Group, the requested fit note, etc. despite the distress they know it causes me. Every single one of my messages is completely ignored. They just send their own that I have to respond to straightaway.

The 'ID' was done and this caused me enormous upset and panic attacks. I had to leave it out in the garden. They paid for two staff to drive to a remote area to look at ID I had already given them. This is all against their operational policy and binding judgment. They do not care. Nothing any of us can do. A law unto themselves. I told the MP's office how damaging it was to my health and explained the deterioration but they told me this was "DWP policy" ?? even though it is against the law.

Doesn't make sense. Help to Claim disagreed with this and urged me to try the MP again. I did so, and the response is above: 'not our remit'.

Everything about the process, in my case, is being ignored. The guidance I sent them, the case law, the harm to my health, the advice from Help to Claim, Social Care safeguarding requests. DWP have gone against all of it.

Thanks for reading, much appreciated. X
