DLA > PIP - Is there a time limitation on Appeals ?

Hiya ,

I'm helping a relative with his PIP review. While trying to gather info on his claim i learned his current award is Enh Mobility, which is a blessing.

However, my understanding is that he was on DLA from a child, due to surgical brain injury, causing drug resistant epilepsy. As an adult he has MH issues, failed so many times to get any effective support. i'm not sure he has a formal MH diagnosis. Recent received a ASD diagnosis.

My question is can i challenge his original PIP award if over 1 year old , esp if he was on higher DLA and failed to comprehend the transition process and didnt have support at the time ?

Hi Sum

There is a limit on appeals. You have thirteen months to put in a late appeal - and you have to say why one was not put in earlier. The DWP can turn down late appeals - they are at their discretion.

Outside of the 13 months, there is nothing you can do.

Im so devastated to find out today that my relative had 'DLA middle care component for help with personal care - indefinitely

PIP was awarded in 2022 - resulting in the care component being taken away !! I'm absolutely flabbergasted and angry at the injustice of it.

I know this is default playbook for a lot of disabled ppl , who don't have cognitive capacity to challenge a system. I thought he had the right support from my older brother. It just confirms the 'system and process' is unfathomable for most of us on a good day 😵‍💫

i know i cant appeal the original 2022 decision. It still stings to think of the way he has been treated and denied benefits.

i have his folder full of dwp paperwork and medical stuff. im going to get stuck in and ready for a fight ✊🏽

Unfortunately, the indefinite DLA awards were not carried over to PIP. It was a deliberate choice to get rid of the indefinite awards because too many claimants had them. I'm sorry that your older brother didn't challenge PIP removing daily care at the time.
