UC questions and worries was created by Adrian
Hello,
I am just after some advice really.
Both myself and my wife made a claim for UC last year in November, we are both autistic and had to make a joint claim.
Before when we were on ESA, i made the claim and i was in the support group and my wife was i guess just bolted on to my claim so we got the couples allowance.
She never had to claim or do anything at all.
But now with UC it is as if we are both claimants and she is being what i can only call harassed by her so called work coach every month!
The claim says i am receiving LCWRA and i don’t have to do anything work related, but my wife has show her fit note from the doctor which is dated until the beginning of June.
She has filled in and sent off her WCA form months ago, yet she is still called every month being asked if she has done anything to fix her autism!!!! And find work!
They won’t give us any info on whether her WCA has been successful and there is no way that we can see of finding out.
They keep telling us on every call that they will call someone to do with disability something or other, but we never hear anything and nothing gets written in her journal.
She is terrified that they are going to force her into training that she can’t do and this will lead to sanctions for us, and also terrified of having to ask the doctor for another fit note, as the doctor is unhelpful.
So she is stuck in perpetual day after day worry.
Is this right?
Should she have to be going through all this.
What can we do and why won’t they leave her alone?
Thanks
Adrian

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Adrian
Unlike partners on an ESA claim partners on a UC claim are not exempt from work related requirements. Your wife has been place on what the DWP call the Health Journey with details here:-
obr.uk/box/the-universal-credit-claimant-journey/
So unfortunately she needs to provide Fit Notes until the result of her future WCA.
When you say the GP is unhelpful do you mean that he may refuse to provide her with a Fit Note?

So is it normal for her to wait over 5 months for the WCA result?
As far as the doctor is concerned, well he may or may not offer a further sick note, i say this because before she was diagnosed with autism he used to tell her things like “pull yourself up with your bootstraps” and give lectures about people fixing themselves up.
So it makes you feel unsupported by doctors i guess.

Hi Adrian
Yes some claimants do wait 5 months and over for a WCA.
You can find out who is your HAAS service provider from the link below and phone them for advice.
www.gov.uk/guidance/find-your-health-assessment-provider
Let me know how you get on.
