I’m Appointee for my son. He was migrated over to UC last September and, because he had IR ESA and CB ESA, he was moved over to NS ESA. I received the UC statement for May today which shows that the increase in UC was taken off my son’s transitional protection...but his total amount of UC is less rather than just staying the same because his NS ESA increased and that is fully taken off the total amount of UC. This means that apart from the increased PIP my son gets he loses the rises in both UC and NS ESA which are supposed to help with increases in cost of living, and when my son’s rent goes up later this year more will be taken off his transitional protection so effectively he will lose the increase in PIP and doubtless more.
I knew this would happen so I not really asking a question but just saying that still seems very wrong especially when press articles complain about the benefits people receive.

I have just replied to another Forum member regarding exactly the same reduction.
The stories that the Tory press and media fabricate about excessive Benefit payments are just propaganda and in reality UC was created to cut Benefits.
The Tories at various times have been against Benefits and the Minimum wage and have praised a model of society based on Victorian values ( Workhouse and Domestic Service ).

I’ve just found this article on the Benefits and Work website regarding compensation that some people who lost their Severe Disability Premium on being transferred to Universal Credit got: www.benefitsandwork.co.uk/news/thousands...-£5,000-compensation
Surely all of the claimants who were forced to migrate to UC and who are now gradually losing their SDP and EDP which I can see is the income related part of ESA which is the Transitional Protection amount and which is being eroded are in the same boat ? The High Court ruled that the loss of SDP and EDP on transfer to UC was unlawful in the past so why isn’t it unlawful to do it gradually as is happening now ?

It is lawful as the government enacted legislation particularly for this purpose with the intention of cutting back on Benefits.

Thank you David - I do not know why this isn't explained to MPs or the press. I certainly plan to explain this to my MP after my son's rent goes up and he loses even more UC.

The news media as you know is very biased. Some portray all Benefit recipients as scroungers and the disabled as just work shy regardless.
