Changes to health after medical was created by Redwood
Dear B&W Forum,
Thank you for your excellent site. Getting stuck in the with reading and research. I am claiming ESA on mental health groundss and have failed my medical. In between attending the medical and receiving the decision, I have broken my leg. Can I request a new medical due to the fact that the mobility results are no longer valid? Or can I only lodge that info at appeal?

In principle, yes you can, however, the key factor with regard to a new condition is that it would prevent you from working, in other words your doctor will need to sign Fit notes for you.

Thanks, Gordon. GP knew I had broken my leg but still only wrote 'depression' on the note. (Can a GP write more than one fit note during a fixed period?).I did however write a cover letter explaining that I had now also broken my leg. Do you know of anyone who has specifically requested a new medical? Is this done by requesting one with the department on the phone? Any thoughts? Many thanks! RR

If you failed the ESA medical and were found fit for work, your GP should have received a letter telling them to stop writing Fit notes based on the conditions you applied for ESA under (depression?).
So they need to write one based on your broken leg, as anything else won't be accepted by the DWP.

My GP who has been treating me for the last 36 years, wouldn't I think take kindly to a so-called disability analyst, who could be an optometrist carrying out a 20/30 minute mental health assessment, telling him to not issue any further sick (not the ridiculously named 'fit') notes.

Many thanks for all replies thus far. Please can you kindly advise how to take steps to alert the department of vital information and/or request a new medical. Of course, they would like me to raise this at my tribunal, but I would like to raise it before it gets to that stage so I can be fairly assessed.
