Hello again,
If you are migrated over to ESA support group after your medical etc, you have mentioned on previous posts that your ill health pension is discounted regards income. Is that the same situation regards savings you may have as well? Plus has there been any descion yet on pre 1995 incapcity benefits claiments regards taxing thier benifit when migrated to ESA?

If you are currently on IB then you should be moved to Contributary Based ESA.
ESA(CB) has an £85 disregard for pension income after which there is deduction of £1 for every £2 of pension income.
note: not all pensions are included and we believe that if your pension income is currently disregarded under IB, it will continue to be under ESA.
ESA(CB) is liable to tax, there is no carry forward of the disregard from IB.
ESA(CB) does not take into account assets.

Does it also mean that esa/cb on migration lasts for a year from the point of migration or does the year start from April 2011 whilst you may still be on IB?Also will pensions currently not included under IB be counted under esa/ir?

I think it will depend on whether the claim is continuous or not. If continuous, then I think, the transitional protection will continue, however, if there is a break in the claim, then it definitely will not, in which case all income and assets will be included.Also will pensions currently not included under IB be counted under esa/ir?

Firstly may i thank you for your prompt and very informative answers to my quiries, plus the answers to additional other posters comments under my heading.
One more question on this subject if i may.Someone under my post has quierid the fact that will the ill health pensions still be disregarded after the one year in the WRAG Cb ESA group, when they move over to IR ESA.
You mentioned that if the claim is continuous or not??? My situation is that ive claimed IB from 1993 and has been continuous, as has my ill health pension which ive had since 1995ish.
So if your not in the support group and eventually migrate after one year to IR ESA will that mean as ive had a continuous IB claim since 1993 my pension will be discounted as that has also been continous ? Is this protection just for the one year?But im confussed as IR ESA is means tested??? or is it only means tested after 1 year transistional period? Sorry to go on but your clarification if possible would be a comfort and sorry for repeating my concerns so often.
