ESA overpayment

My circumstances have not changed i still have a sever disablity and will hopefully be done justice when my appeal is eventualy heard.
I dont mind paying it back in small amounts,providing they are willing pay me it back if my appeal is sucsessfull.

I didnt report a change in circumstances as there has been no change in my circumstances as far as im concernd, i didnt report a change in circumstances, The dwp have assumed there was a change in circumstances when they decided (imo wrongly) that i was no longer entitled to DLA. which im currently appealing.

there is another way out of debt so old if a debt is more than 6 years old sometimes in the UK they cant enforce it might not count with the DWP but worth getting advice
a change is not just in your health but in anything to do with the claim and is laid out in regulattions and should be written down in the letter you get each year when your claim is up dated

I think what the DWP is saying is that when the DWP cancelled your DLA, they didn't tell the DWP that they had done this, and as a result the DWP continued to pay your SDP.
You should have realised that the DWP would not tell the DWP about the benefit that the DWP had cancelled and should have contacted the DWP yourself.

I think what the DWP is saying is that when the DWP cancelled your DLA, they didn't tell the DWP that they had done this, and as a result the DWP continued to pay your SDP.
You should have realised that the DWP would not tell the DWP about the benefit that the DWP had cancelled and should have contacted the DWP yourself.

if i had been drinking tea i would have just spilt it thats actualy hillarious!
Im going to just write to them and ask what is the minimun payment i can make eaech week and can i claim it back if my appeal is sucsessfull

The duty to report a change of circumstances is defined in section 32(1) of the The Social Security (Claims and Payments) Regulations 1987.
As strange as it may seem, a claimant is still required to report a change of circumstances, even though the DWP should already be aware of the fact that a change of circumstances had occurred with one benefit, which may impact upon another benefit. This still applies even if you are appealing the termination of the benefit, in your case DLA.
