Hi everyone a freind of mine has just had a new esa medical and was told if he failed his medical he could not appeal the decision many thanks ..........

What your friend has been told is patently incorrect.
If he fails the 'new' ESA medical (WCA), he has the statutory right to appeal the adverse decision.

i have heard that also ,its worrying as i have been moved from ib to wrag before the atos medical results, was available to the works and pension seem i was very fast tracked ............

I am interested in two things-
1) who told you that you would not be able to appeal?
2) please can you explain how/why you believe that a decision has been made on your claim before DWP had access to the ATOS recommendation?

1 i am sure it in a newspaper somewhere;??
2 i telephoned works and pension, to give me a explanation to why i was put in the wrag group, and i asked them have you recieved the atos medical report, and works and pension denied they had received the report, i am still waiting myself for the report,they said that was good as my 365 day has not started yet its so very confusing ???
