A dilemma was created by Steve
Hi,
I have a dilemma in that my wife receives DLA indefinitely (HRC/LRM) and I receive CA for her, she has been in hospital for three weeks now and I think I have to inform the DWP after four weeks of her stay in hospital, now her condition has changed because she has had pneumonia and now she has Guillain-Barre syndrome and as a consequence she is unable to walk at the moment or anytime soon we are told, but the outlook is good with every chance of a recovery at some point in the future - the consultant mentioned the term "how long is a piece of string" when asked about timescale, it must be a medical technical term!
My dilemma.
What do I say to DWP?
My wife MAY be discharged home soon if they can arrange the physio she needs and have bed, commode etc downstairs.
She may be sent to rehab hospital directly from where she is now for anything up to 4 months until she is able to regain some sort of mobility (if they cannot arrange home physio) and be able to come home.
What will happen with our benefits?
I presume they will all stop but do we have to re-apply all over again when she is out of hospital or will they just be reinstated again?
Am I entitled to any benefits or would I have to sign on to jobseekers and wait for the claim to be assessed - I would not really be looking for work as my wife may well be home next week or maybe the week after that, you see my dilemma?
We still have a mortgage that we have to pay ourselves out of our meagre allowances plus all other expenses like everyone else, if we were in social housing it would be slightly different I think.
The is a lot of if and may about all of this I'm afraid.
I am at a loss as what to do next so any advice would be helpful.
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

The advice for hospital stays is that you should report the situation to the DLA and Carers Allowance teams immediately.
From what I can find, DLA may be stopped after 4 weeks in hospital, however, you may still be able to receive CA for upto 12 weeks. See here

Carer’s Allowance
If you are claiming Carer’s Allowance, you may be able to continue to receive it for up to 12 weeks out of a 26-week period; this will depend on how long you have been a carer and whether you have had a break within the last 26 weeks. If your loved one has to go into respite care, your Carer’s Allowance will stop after four weeks.
AA and DLA
Attendance Allowance and Disability Living Allowance (care component) are suspended after 28 days in hospital. If your loved one gets one of these benefits and is in hospital, inform the Disability Living Allowance and Attendance Allowance helpline asap as I have known others to delay the information only for the relevant agencies to deduct overpayment at a later date, (which could be when your wife returns home & when you most need the money)
