ESA reconsideration success was created by injuredcyclist
Hi injured cyclist's husband here.Im typing this because she's had a setback and cant use the computer.
She wanted you to know that she asked for a reconsideration about being put in the WRAG group in ESA after an ATOS medical,and that she has received a letter saying she has been moved to the support group.Result!
Thank you to the website and the forum members who responded to her questions.We wouldnt have succeeded without you.
For the reconsideration I sent a detailed letter explaining her day to day existance,I also explained that medical investigations were ongoing.I also put which points of the medical we disagreed with and why.I included supporting letters from her G.P.and her Headway support worker.
We are now wondering whether to question the 6month review date because this was based on incorrect medical information.
Hope this is helpful to people out there-dont give up!

A tribunal is just like a court, to put your case your legal person puts you in the dock and asks you questions, I suspect/expect in a tribunal you can use leading questions..
for example in court
"how far can you walk"
where as at dla esa tribunal, I suspect it could be worded
after a couple of steps your in pain and need to stop and use your gtn spray.. how long does it take to recover ?

Hi Dave,
Just for clarification, as you rightly say a Tribunal is a Court of Law, but an informal one. There is no 'dock', The Tribunal Members just sit at a table, with the panel at one side and the appellant, their representative ( if they have one) and friend or family member ( if they're present) at the other side.
A Tribunal's role is 'inquisitorial', which means the appellant can expect to be asked questions, and vice versa. This is totally different to criminal courts who's role is adversarial.
