i have an occupational health report which i sent back with my esa50 form. in light of details on your site should i also be sending a copy of this report to the DM at my local office who is dealing with my current esa claim. I thought it was all the same place.

The Atos office and the office which deals with your ESA claim are entirely separate, and therefore it is essential to send a copy of the OH report to the JCP/BD office which handles your claim.

I am rather confused now, on reading your reply as quoted above, it seems to conflict with this post :

I gather that you may only be refering to the sending of the ESA50 itself to the DM, at you're local BDC.

However, you do say correctly that the DM is not medically qualified.

Further, that the DM would have to consult with ATOS before making an award, and could therefore not make a standalone decision on the ESA50, and would anyway see copy of the ESA50, before making a decision.

So in the OP's case, as he sent the OT report with his ESA50 to ATOS, surely it then becomes part of his WCA, and in some way an intergral part of his ESA50.

Therefore, taking your advice to the OP into account, what is the difference between this, and info on your post on the link above provided.?

I hope you understand my confusion here.

Do you mean the copy of the OT report must be sent to JCP/BD? As the other day you said no point sending copy of ESA50 to JCP/BD.

Just my two penn'orth.

The ESA50 goes to Atos because it forms the starting point for their report. However,their report is based on their assessment, whereas the DM is supposed to take into account all evidence available to him/her.

So additional evidence gets sent either to the DM or to both the DM and Atos (if you think the Atos assessor will find it helpful when conducting the assessment).

A decision maker cannot possibly make an ESA decision on a claim without a copy of the ESA50, as the ESA50 is the basis of the claim for disability. For this reason I don't think it is necessary to send a copy to the DWP.

A decision maker may make a decision without reference to any medical evidence that has been sent to Atos if the documents have been lost in transit and he is unaware of it's existence.

The new ESA50 has a box to tick to say that you have provided medical documents, but given that the old ESA50 actually asked you not to send medical documents with the ESA50 and HCPs have sometimes refused to look at them when a claimant presents them at a medical assessment, I wouldn't have a great deal of confidence that all the documents you send to Medical Services will be passed on to the DWP.
