IS and IB combined was created by mastineo
Hi all
I been claiming Incapacity Benefit with a Income Support 'top-up'.
Last week the Incap wasn't paid (Friday) but the IS payment went in on Monday, but for the whole amount.
Apparently I'm no longer on Incap!!
Anyone else experienced this?

Have the DWP sent you written confirmation of the decision to terminate your IB?

If not, it is a statutory condition that any decision to amend/terminate a claimant's entitlement to any benefit must be conveyed in writing, as in the overwhelming majority of circumstances there is a statutory right of appeal against social security adverse decisions.

Contact your local JCP/BD office that deals with your IB claim, and ask for a formal revised decision letter.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi mastineo,

Yes I have, was paid and entitled to Cont/IB, then was awarded IS top-up through guarantee premiums.

After that all IB+Top up premiums, paid from IS, I queried it, and was told it was normal procedure.

So don't worry.

cheers

No, have had no correspondence.
I phoned the Job Centre and was told that because the payment dates were so close together it made more sense just to send one large(r) payment than two smaller ones and that I had nothing to worry about!
Financially I'm no worse off, but dont know what the implications are.

Further to the above, just checked my most recent benefit award breakdown letter from IS, (which you should receive) and even though all is paid as IS, it actually states in the breakdown,

"Incapacity Benefit for Mr/Mrs xxxx xxxxxx, £xxx".

What tends to happen is depending on your pay day, you will receive your IB part alone some weeks, and other weeks IB+IS, as I said depends on your pay day.

So as I said no need to worry.

cheers

If for some reason you lost your entitlement to the top-up premiums, e.g. if an award of DLA care was changed, you would still be entitled to your IB.

Obviously, still taking into account any possible migration to ESA.
