I am going to appeal ( prob Dec 2011 before hearing )and have found out the Dr who assessed me has already had a warning for similar ommisions as my medical.Should I disclose this fact to the Tribunal or will it be frowned upon to bring it up
Thank you

Do you mean this doc has had an official warning about something he did? Was this warning in writing?

If so then it could be a material fact which could be presented to the tribunal service before your tribunal meets suggesting they use another doc's report.

Of course you may not get a more sympathetic doc the second time and, even if another doc agreed with your own view of your condition, he may not much want to go on the record as contradicting a professional colleague.

Hi Finni
Yes it must have been an official warning as found it under his name on GMC register. It states "this doctor has been given a warning " then goes on to give the reason part of which states "his examination was inadequate and the findings in his report were not clinically justified "Still can t make my mind up whether to send copy to tribunal or will they already have these facts to hand.
