Hi

I had a medical at the DWP for Industial Disablement Benefit on 13/07/09 regarding osteoarthritis of the knees.

The Doctor at the medical awarded me a disability of osteoathritis in both knees for life.

He recorded a loss of faculty that affects walking,using stairs,kneeling and squating,ect.

Can i use this as evidence for ESA when I get migrated from INC/BEN.to ESA.

My concern is that the report is more than 6 months old and im led to believe that supporting evidence longer than 6 months old is ignored.

My argument against this 6 month rule is that the award for IIDA was for life by the Atos Doctor and therefore my condition cannot improve unless i have a total knee replacement.

Has anyone got any thoughts on this please.

hi just a thought your condition will not improve without knee replacement does not matter whether the report is 1 month old or 12months old so on that basis iwould get my MP involved and get him or her to contact CHRIS GRAYLING and ask why can DWP use Information that is 12 months old but claiments cant the more people who ask questions of CHRIS GRAYLING the more of a chance we have of a fairer system iam waiting for a left knee relacement which probally will be another 5 years good luck peter
