With regards my medical, getting 0 points makes me now know what a UK entry to the european song contest feels like.

Based on this medical score/report I feel I should let the uk olympic team I can be free for whatever they are short of as you seem to think I am very fit.

But based on the "facts" I am in pain at rest before I take steps and needing a new right knee and left hip I feel my chance of gold is slim. So before I get on the phone to the uk team... would you please look at my claim for esa again as I have no idea how the atos dr failed to give me any points ?

agree If I fail the esa50 and get no points or need a medical I will have to work hard to beat this one ....and hope too to make people laugh because we have a hard life we still need to find some fun in life IDS getting arrested for kerb crawling would be a start

It is my opinion that ATOS Dr's are only carrying out a superficial physical exam. Therefore their opinions are mainly suited to illnesses that get better over a certain period of time e.g. a broken finger. I think they are given more weight than they warrant after all it is just one person's opinion and is not scientific.

I think Law For All can cope with such simple cases using a computer point based system but lawyers are not often given enough funding to deal with complex cases.

For example for those who get 0 points shouldn't it mean that the claimant would need to take a different route.. This might include obtaining HCP evidence for common problems related to tiredness, low energy levels,to convey the severity of the symptoms and how it affects their care and mobility needs etc. An arthritic finger in comparison to a broken finger is unlikely to be resolved easily.

A chronic illness that affects your day to life could be better sorted out by a Welfare Rights Officer and a Judge/Tribunal using the ATOS medical report as a type of yardstick only ...
I for one do not feel the ATOS EMP report is in-depth enough without Medical Reports from GP's, Consultants, etc. to give a more holistic picture.
In my case the decision-maker seemed to seize the opportunity of stopping my DLA solely on an inadequate and biased EMP report that seemed to have been written to deny me my benefits I have had for some years.
It is obvious to me that most chronic illnesses such as RA, MS, Parkinsons etc. are complex illnesses and when given the diagnosis it should automatically entitle a patient to the higher levels of Care and Mobility especially if the GP gives written notice that work is not an option!
This will save costly fees of Tribunals,
and the money saved could be directed to those that are often denied it. The Submissions need to be more concise with standard forms completed by HCP. The unnecessary impersonal clerk at the DWP could also be eliminated! The DWP are sending us on a wild goose chase!
