Can I avoid a certain doctor at ESA medical was created by Melanie Tudor
Hi,

There have been a number of complaints about the inaccuracy of a certain doctor in our area who carries out ESA medicals. An example of his inaccuracy is that a friend of mine took his wife in a wheelchair to the medical room (she has a stroke amongst other things)and she did not 'pass' the medical. He later found out that the doctor had written in the notes that she 'walked into the room' which is not actually possible.

In all the complaints I have heard, the same doctors name comes up time and time again.

Do we have the right to insist that a specific doctor does not carry out an ESA medical?

regardless of anything the dwp might say you have the right to which drs treat you be it at your gp practice or hospital ..one thing for sure unless there are certain things wrong with you, you cant say to atos i want a dr not a nurse..only in certain cases does it have to be a dr from atos.......

Nurses and physiotherapists do effectively the same job as doctors in the centres, but do not see people with neurological conditions such as stroke or multiple sclerosis. that from the blurb atos tell new drs

You cannot exclude or request a Doctor of your choice.
This is a lottery of who you get. All I can suggest is that preparation before interview is paramount.
Do not lie but at the same time explain how your condition affects you. Take somebody with you as a witness to what has been said.
I have accompanied several people at medicals and have found their empathy for the first 15 minutes has been good and then the screws are turned on.

Where did you get this information from ? and since when have drs been able to force someone to be seen who did not want it so, the moment you tell a dr you want another to deal/treat you he is not able to carry on

I have deliberately held off commenting on this topic because I have not been able to find a definitive answer to the original question.

However, I do think that members need to be cautious of refusing to accept a particular doctor as this could, not saying it would, be consider as a technical failure to attend and you would need to show good cause why this has happened.

I do take your point that it is same doctors name that is coming up but similar inaccuracies have been written in so many peoples reports up and down the country. I have had it myself and whilst we don't want to have to appeal, if an inaccuracy like that is put on your report then you have excellent grounds for appealing.
