re 12 month limit of ESA contribution base was created by citymike
If the 12 month time limit for payments of ESA for people in the WRAG goes ahead when would my payments stop .
I recieved a letter dated 3rd june, saying i had been transferred to ESA from IB and the move would take effect from 28th june.
2 weeks ago i recieved a P45 from the Incapacity benefit office saying my payments of IB ceased on 8th August.
So my question is does the 12 month rule backdate to 28th june or the 8th august.
Just wondering if anyone else has recieved a P45 giving a different transfer date than stated on their original letter.

It does sound like a mistake, but assuming you have been receiving ESA from 28th June I would expect that this date will be used for the calculation.
Make sure that you check that the amounts on your P45 are correct.

Hi derek4 re last question at the end of the 12 month limit what does citymike do then? is his esa payment going to be replaced with another payment or does he go without?

Following 12 months of contribution-based ESA, a claimant may be transferred to income-based ESA provided they can satisfy the means test.
If the means test is satisfied, ESA will continue to be paid at the appropriate rate depending on an claimant's personal circumstances. If the means test is not satisfied, no further ESA will be payable after the expiry of the 12 month period, even if a claimant is still incapable of work.

I have contacted my MP to voice my concerns re the 12 month limit, and my wife also wrote a letter to ask how we could be expected to live on her income alone,as well as her having to go to work,she also has to do virtually everything at home due to my incapacity.
My MP has raised my concerns in the form of a Parliamentary Question, but this will probably not get dealt with until september due to MP's being away.
I will keep you all up to date when i get a reply.

Well done bringing this to the attention of your MP.
Have you considered claiming Disability Living Allowance, a non-means tested benefit, full details can be found here on the B&W site.
