Just a quick question, if you suffer with depression and anxitey but don't want to take antidepressants would you still be awarded the points on the esa form or does it have a lot to do with the medication your on? Thanks

As depression and anxiety constitute mental health problems, the diagnosis is as equally if not more important than the treatment.

Insofar as antidepressants are concerned, they are no longer recognised by the National Institute for Clinical Excellence (NICE) as a front line treatment for mild/moderate depression, and therefore will not necessarily be prescribed by a GP/psychiatrist. Furthermore, many people with mental health problems choose not to take antidepressants because of unwanted side-effects or for other various (personal) reasons, and prefer to try alternative therapies such as cognitive behavioural therapy (CBT), psychotherapy or counselling.

Consequently, because a person does take antidepressants, this does not detract from the fact that they have a mental health problem, and therefore this should not preclude a claimant from scoring points under the mental health descriptors, for the purpose of the WCA.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
