after esa appeal query was created by wshad
I won my ESA appeal today from getting 0 points from ATOS to 33 points at the appeal, thanks to the help from this site. Which it the best £20 i have spent :cheer:

There is one thing i am not sure of though on my decision notice it says
The appellant is entitled to Employment and Support Allowanse (ESA) with the work related activity component

Does this mean i will be put in the wrag group?

and it also says at the bottom
The appellant does not meet the conditions of any of the descriptors in Schedule 3 ESA
can any one tell me what this means please

thanks
jim

Jim

Congratulations and thank you for letting us know.

The Work Related Activity Component is the same as the WRAG.

Schedule 3 (pre 03/11 WCA) refers to the Support Group criteria.

So you scored more than the 15 points required for the WRAG but did not meet any of the criteria for the SG.

Hope this explains it.

Congratulations, Jim

The discrepancy between ATOS zero and Tribunal 33 is truly astonishing. How could ATOS get it soooooooo wrong?

Thanks for reporting your victory. Gives hope to us still waiting (on zero points, too!)
Andy.

PS: How many months did you wait for your hearing?
