Hi everyone,
I am after some advice.
I was migrated from IB to ESA in June11,and placed in the WRAG without a medical.
Since i sent in the ESA50 assessment form detailing my physical and anxiety problems,i have been diagnosed with Fibromyalgia.
I wrote to Jobcentreplus in July to inform them of the diagnosis, and they rang me to say that my letter has been passed onto another office. I have had no contact since.
I was speaking today to my MP's office, and they said that as i felt my condition has become worse, and that i have a new problem(fibromyalgia), i should contact Jobcentreplus and ask for a review of my claim on the basis of a new diagnosis.
I have contacted CAB who agree, and said that if they come back and do not change their decision i would be able to put in an appeal.
Does anyone have any thoughts on this.

Hi Citymike
The advice given by your MP's office and the CAB seems emminently sensible. B&W produce a wide number of guides on how to make claims and how to appeal, in the Members Only orange section, but we are unable to give specific advice regarding a claim, on this forum.
Kind regards
Michael

Nothing on this board constitutes legal advice - always consult a professional about specific problems

As you are currently in the WRAG, do you believe that because of your FMS, you now qualify for one of the ESA Support Group criteria?
If not, then you should think carefully about whether there is any value in asking for a Supersession of your current award.
Asking for a review will undoubtedly require the completion of a new ESA50 and as this is a new condition, it is quite likely that you will have to attend a medical.
You need to be aware that a review will be done on your award in full, not just the new condition, and whilst it is unlikely, given that you qualified for the WRAG without a medical, that your existing award could be removed, it is still possible.
