Implications of DLA delay was created by Tylluan Penry
The DWP have taken an age to decide my renewal claim for DLA even though they received my completed questionnaire months ago. My last payment under my old claim is due this month.

What I am wondering is the implications of this delay. Must I send back my disabled road tax badge and retax the car myself? (It's not a motability car).

Also must I notify HMRC as soon as the claim runs out and they will reduce my tax credits?

It's so annoying because I did everything in plenty of time. The DWP are only just contacting my GP for a report!

Any advice would be very welcome. Many thanks.

It maybe worth ringing the DWP Disability and Carers Service on 0845 7123456 and explain the situation and enquire what advice they can offer.

Technically without an award of either the High Rate Mobility Component of Disability Living Allowance or War Pensioners Mobility Supplement, the disabled vehicle excise licence becomes invalid. I don't think we can say more than that to be honest.

It would seem that as it is a change of circumstance, it would be worth informing HRMC, also your local authority if you are in receipt of Housing Benefit and/or Council Tax Benefit.

However I would most certainly ring the DWP first.

Pete

Hi,

I applied for my DLA back in March, as the months went by and didnt hear anything I notified motability because my car was due back after the 3 year lease at the end of August.

I asked them what would happen to my car if the DLA was disallowed and what I should do if I hadnt heard anything by August.

They extended my lease by 3 months and said that if i wanted to order a new car I could do because the old award notice of HRM indefinately still stood until I heard different.

The only stipulation was that I kept them informed about any letters or decisions etc if i ordered the new car and if I lost my award I would have to appeal.

Dont know how much sense this makes actually Im having a bit of a problem with my brain today !

I've now contacted the DWP - they say that I will have to buy more car tax since the old one will not be valid once my claim runs out at the end of the month. I can then claim a part refund (i.e. it will still cost me money) if the renewed claim is approved. It's not a motability car and there is no leeway with the road tax.

I rang my GP - they haven't long had the request for a report and are snowed under, so that could take months too.

Basically it's anyone's guess when it will all be sorted.
