Hello All,

I registered for ESA last AUG due to 3 prolapsed discs, I filled out a ESA50 and had to attend a ATOS medial, anyway I earned 12 points from the medical and had to appeal the decision which in March got turned over and I was put into the support group..

Ok I have been in the support group now since March and a ATOS ESA50 form has come through the post. I phoned DWP up and asked if this was correct and the guy who talked to me said this shouldn`t of happened on the support group there must be a mistake and he got another advisor phone me back.

The other advisor said I must fill in the form and attend another medical..

Now for the last year I have not been lying down enjoying myself I have had to constantly attend Hospital my condition has got worse and since last year I have now been diagnosed with epilepsy due to me having seizures and also I have been diagnosed with a heart condition and possible Brugada Syndrome which could kill me within 4 mins, but that has not been confirmed yet.

Is this right? am I supposed to be reassessed so quickly? And if I fill in the ESA50 to the description the guides suggest and also add all my other problems and send in evidence proving all these appointments and specialist reports what are my chances of having to attend the medical?

Technically you have not been assessed since last August as the Tribunal is only able to consider evidence that was relevant to that Decision, so I am afraid you need to complete this new ESA50 in order to continue receiving the benefit.

Unfortunately, there is no way to say whether you will avoid a medical this time around. Remember, whilst your diagnosis's are important in supporting your assertions on the form, it is your ability to meet the ESA criteria, that will determine whether you continue to qualify.

The guides explain the criteria and how the ATOS "doctors" apply them, and how to explain your own disabilities where relevant.

Hi subplay,

I'm afraid the short answer is that yes, you do have to complete the ESA50, especially as it has been over a year since your last one. But the DWP advisor who said you will have to attend a medical can't possibly know that.

Unfortunately neither can we. All we can say is that if you complete the ESA50 in as much detail as possible and include supporting medical and other evidnce if you can obtain it, then that is likely to reduce the chances of your having to attend a medical.

On another note could I claim DLA having 3 prolapsed dics, damaged nerve roots, haivng seizures and a heart condition do you think? Also I have to use a walking stick to get around and have patches over my left foot and both legs of numbness...

Have a look at the Claiming DLA on Physical Grouds in the Members Only area, if you believe you meet the criteria for the care and/or mobility component(s) then you should consider making a claim.

However, remember that your ESA50 must be returned by a specific date, so I would suggest you concentrate on this first.
