Any sanction has to be notified in writing and carries the right of appeal.
The situation with regard the stopping of ESA(CB) after 365 days is less clear, the DWP have undertaken to notify claimants, see
12 Month Limit for ESA(CB) – Implementation However, as there is no Decision being made to terminate payment, and the legislation does not include any specific requirement to notify the claimant, unless there is a more general requirement to do so, then the DWP may not be required to. That said, I would still expect a claimant to receive a payment notice with nil amounts after the event.
