IB to ESA Support Group without medical was created by SCHSheff
I want to thank you all for your clear guidance which kept me focussed as I plodded through the ESA50. I was informed by phone last week that I am being migrated from IB to the ESA support group without a medical and had written confirmation of this at the weekend.

I asked the woman who phoned me when I could expect to be reassessed and was told 18 months (worry is already gnawing away at me about that but I suppose that is the way of it from now on).

I want to acquire the forms relating to the decision to find out where I was given points and how they arrived at an 18 month prognosis. I find the DWP's SAR form you direct people to confusing. A few questions:
- Do I tick both 'computer records' and 'clerical records' next to the ESA box?
- What do I put down as the 'from' and 'to' dates?
- Am I seeking both the ESA85a and the LT54 forms (my GP wrote a letter focussing on the relevant descriptors so I am not expecting an ESA113)?
- Do I give the DWP office on my ESA confirmation letter as the location of the records
- Or, since this is not in relation to an appeal, shall I not use this form and simply adapt the letter on page 12 of your Appeals guide (and just ask for the above forms and not any other correspondence or communication)?

Congratulations on The SG award. :)

Thanks for the positive feedback regarding B&W.

You can use a SAR form or a letter, either would be covered under Data Protection Act 1998, and a request for personal information.

You can particularly name The ESA85A, and LT54, as they will definitely exist.

You can then add wording to the effect that you are also requesting "ALL" documentation used in coming to the SG decision (of DATE)

To clarify further, you can particularly request the length of the prognosis of the SG award, and the descriptors that were applied in coming to the SG award decision.

Any dates should cover the period from just before the process began, until after the date of the SG decision notice letter.

You can address it to The DWP Benefits Office on the decision notice letter.

Write DPA 1998 SAR, in front, left, top corner of the envelope, and address it FAO The DWP Data Controller.

They then have 40 calendar days to comply, from receipt of The SAR.

Blimey, that was quick! :)

Thank you for fulsome reply. I will send an adapted letter because I really think the SAR form confuses by trying to cover too many scenarios. I can see that you really have to be clear about what you're asking for. Your tip about writing info on the top left hand corner of the envelope is spot on - where else would I have found that out?
