At last, all but a few weeks shy from a years wait !!! There must be a hell of a lot of appeals.

I've now 2 appeals within weeks of each other (one for ESA, and one for IIDB Pension) I'll be glad when its all over, but somehow I've a feeling the ESA, and DLA will start as soon as they have been concluded/conducted !

I've tried looking for my older posts to keep them up-dated but can't seem to find them ?

Well guy’s I guess you can add another one to the statistics for ATOS/Decision Maker, getting it O so wrong !!! :P :P :P

I was awarded ESA in the support group for a period of 18 months from today ! All from a decision that I was fit enough to claim Job seekers allowance.
I commented on the final medical report being so different from the examiners comments and findings ?

The doctor on the appeal board explained, (as she had in the past done such medicals) The software the examiners have to enter information in is very limited and no comments or remarks can be entered, its usually just a yes or no answer you have to give, so the final report you receive may be well different from the conversation you have with the examiner. He may well agree that your mobility is an issue but can only enter certain information which is then interpreted by the decision maker.

It's a good job I read those guides of yours ! The information contained has helped me a hell of a lot !!! Many thanks guy's keep it up !

Is there an increase in money now I’m moved into the support group ? …also is there some disability premium you can also claim ?

With DLA, ESA and keeping my Indus Injuries Ben the same, I guess I've done quite well although you shouldn't be put through this much stress, especially when the fat cat tax dodgers get let off with paying their fair share !!! 30 years of work and paying Taxes, to have to fight to get on the sick, it's a disgrace.
I'd like to know where all the scroungers and disability fraudsters are, as what I've had to go through, I can't see anyone getting away with it ? Well that's my rant over, guess it all starts again in April with a DLA Renewal ...

Congratulations on winning your appeal, and being placed into The SG after initially being found fit for work. :cheer:

I don't wholly agree with the comments above as if the assessing ATOS HCP enters the correct information, the LiMA software will come up with the correct recommendation.

Further, there is a facility for the assessing HCP to input added comments, and they can hand write added comments in The ESA85S Personalised Summary Statement (PSS) as an add on to The ESA85 medical report.

Anyway, that is bye the bye. :)

You should receive no less than you were receiving before being transferred to ESA, although you may receive more :

What will I be paid?

Whether this was a fresh claim for ESA or a migration, then you will be owed the difference between what you would have received if initially placed into The SG, and what you have been in receipt of whilst appealing the fit for work decision.

You may also be entitled to premiums :

ESA Premiums

To be entitled to any of the listed premiums, you would have to be entitled to IR ESA, as all premiums are paid in the form of IR ESA.

To be assessed to see whether you pass the means test with respect to household income, assets, capital and savings, you would have to request, fill in and return an ESA 3 financial assessment form.

You should request the ESA 3 from the benefits office dealing with your ESA. You might also want to send them a copy of the tribunal decision notice, which may speed up the updating of your file.

Cheer's Bro, first time I've ever been off work in over 30 years so it's a fresh claim for sickness benefit, or as it's called now ESA :laugh: Things have changed in my time from just handing in a sick note to the Social Security Office :cheer:

I have been paid the £71 from Dec 4th 2012

I guess now I'll look into the permitted work aspect as it's killing me sitting around all day...

Hi B,

You should be owed the differential between the £71 and what you would have received in The SG from that date.

Regarding Permitted Work, you should be aware that only the DWP can decide whether any work that you may consider will be classed as Permitted Work.

Further, you should also be aware that any Permitted Work that you may attempt to do will be taken into consideration with your ESA assessments, and whether it is contradictory to your ESA award.
