DWP made PIP reconsideration without being asked was created by J The Divine B
DWP was requested three times by phone in June to supply the HCP report on PIP home-based assessment so that an effective case could be prepared and made for reconsideration request. I also sent a follow up letter in August.
On each occasion the DWP was asked the time frame permitted to put in the grounds for reconsideration request.once the HCP report was supplied. to me.. The HCP report arrived at last in September.. The DWP have admitted in October that they undertook a reconsideration in August and have not changed their original decision.The reconsideration was made without my requesting same---as I was waiting for HCP report
I was clearly not given the opportunity to a) scrutinise the HCP report, thus preventing me from b) producing robust grounds for reconsideration.
I am going to make representations to tribunal about reconsideration made without my requesting.
Any advice or pointers please?

I'm sorry that DWP didn't get the form sent to you promptly, and that they then undertook the MR without waiting. I'm afraid this is not the first time we have heard this!

You could try and push for a 2nd MR, we have heard of it happening but it is certainly not common. Otherwise your next step will be appeal.

You can mention the fact that DWP didn't give you the best chance of a successful MR but the Tribunal have no power over DWP do the most they can do is make disapproving comments! It certainly won't gain you the award you deserve, you will only get this by showing how and why you score points against the descriptors.
