I appealed to the Upper Tribunal following losing my PIP award in January 2015 and subsequently challenging the decision of the subsequent tribunal. The Upper Tribunal ordered a fresh Tribunal be held which happened in November 2017.
The second tribunal was even worse than the first. I wrote a letter requesting leave to appeal to the Upper Tribunal again. I have just received a Decision Notice from the District Judge saying that the decision is set aside and will be heard again by ANOTHER tribunal. It says there is no need to go to upper tribunal as the decision has been reviewed under Article 40.
My question here is does anyone know how often this happens? I mean one decision going to 3 tribunals and being set aside twice?
So this will be the third tribunal for the same decision
