Can I avoid a certain doctor at ESA medical

regardless of anything the dwp might say you have the right to which drs treat you be it at your gp practice or hospital ..one thing for sure unless there are certain things wrong with you, you cant say to atos i want a dr not a nurse..only in certain cases does it have to be a dr from atos.......

Nurses and physiotherapists do effectively the same job as doctors in the centres, but do not see people with neurological conditions such as stroke or multiple sclerosis. that from the blurb atos tell new drs

Atos ADA's do not 'treat' you. They assess you. Medicals are no longer called medicals but face-to-face assessments, which is much the same as an interview.

If a claimant could excluded an ADA from carrying out the assessment because of previous inaccuracies in their medical reports, there wouldn't be any ADAs left that meet the criteria to carry out an assessment.

Even when I passed the PCA the doctor that assessed me stated that I experience several panic attacks a day. I've never had a panic attack in my life!

I'd like tto add the same happened to me as happened to Derek, observations which can only have been invented . The assessors come from all walks of life and vary in attitudes, they dont all join ATOS because they are intending to make like difficult, and even those that do have a hard attitude may well think some people need a few extra points
It isnt really 'right' but how can I coi=omplain about it. Dear DWP please assess me again the doc was too helpful... well in fact I would have passed anyway but I was certainly assisted

Dont refuse that doctor,. Just put your c ase in writing in the ESA 50, get a letter from you r doc if you think it helps comfirm your level of disability, and take a friend.

I have deliberately held off commenting on this topic because I have not been able to find a definitive answer to the original question.

However, I do think that members need to be cautious of refusing to accept a particular doctor as this could, not saying it would, be consider as a technical failure to attend and you would need to show good cause why this has happened.

I agree that saying no could be very dangerous and expensive I also note the other post now saying its not a medical ... that might well be away around peoples rights I will phone the GMC and ask them :)

The GMC told me they make sure Drs are carring out good medical practice, and regardless of any rules Atos or the DWP want to set down the first condtion of how he or she works has to be by the GMC rules to put the patients care and well being first.

The moment someone says to dr him/her
"I dont want you to carry out this interview or medical" they HAVE to address it, you dont have to give any reason to the Dr.

You would have to have a reason and just like at your practice you can talk to the practice manager and sort out another dr you can take the matter to Atos you would have to give them a reason for wanting another dr.
Atos would not tell the dr why you did not want to see that dr.

Any request is best taken up with atos before the day of the medical.

If atos and the dwp stopped your esa IB dla till such time as the medical is done thats nothing to do with the dr.


the word that bothers me is gmc says "address" the problem ?

I asked if this question has been asked before and they said a few times in recent months.
