esa form time limit to send it back

Thanks Gordon, I cannot walk unless someone physically holds me up and I cannot push manual chair due to severe arthritis, I've been seeing an osteosurgeon about both my hands. I put all of this in my esa50 form

I am afraid, as a Decision has been made, your only way forward is to challenge it by either lodging an Appeal or asking for a Reconsideration.

You should request the documents used to make the Decision from the DWP, see

ESA medical – what forms to ask for?

There may also be an ESA72, which will show what points you scored.

Thank you Gordon, btw my daughter is doing all the typing as I cannot due to arthritis in both hands.
If I appeal, I gather I need to ask what they based their decision on and that will take more time. Also should I have started a new thread with all these questions or is it okay to continue on this thread?

Your (her) posts are fine :)

Yes, you do need to understand why they have not placed you in the SG, however, you do not need to go into detail as to why you are appealing, so you do not need to wait for these documents in order to submit a GL24 appeal form. As you are receive WRAG payments, you have the luxury of waiting to see whether the documents arrive in time, but if they do not, then our recommendation is to lodge the appeal within the one month allowed.

Hi Gordon, sorry if this seems a stupid question, but the documents you mentoned are these the statements of reasons? Do I need these before I send in the GL24?

A Statement of Reasons is a very special document defind in law, the problem is that there is no clear definition of what constitutes a SoR and the circumstances in which a SoR can or has been supplied, it is for example; perfectly possible to remove the requirement to provide a written SoR by explaining the Decision over the phone, even though the claimant may not have realised that this had been done.

So you can request a SoR as one of the documents listed in the link I previously posted, but you should not wait on it to be provided if this will mean that you do not lodge your appeal within the one month available.
