Hi everyone,
I hope you are all looking forward to the better weather this week! I have a question - I am currently going through a mandatory reconsideration for PIP as they denied it to me even though I have had DLA for 5 years. The trouble is that I also get tax credits based on my disabilities which is really what I survive on, I am self employed but only work very minimally 3 hours a day a week due to my disabilities, I cannot manage without it. I haven't had my results yet but they are stopping the tax credits until I find out what is going on. Is there anyone else had this experience? Tax Credits say ring PIP to find out & it has been a month since I sent my reconsideration in do you think this is a good ideas? I have a week to send my form back otherwise they will stop it. Feeling very worried as I live on my own and struggle to manage.

|We don't deal with Tax Credits on the forum so I am limited in the advice I can give.

If you have not had a decision yet on your PIP claim then I don't understand why TCs have been stopped as you will still be receiving DLA and will do for at least four weeks after a decision is made, I assume you therefore still meet the criteria for payments, I would contact HMRC to query the suspension.

Thankyou for that - I have just found out that I won't be awarded anything at the mandatory level so I will have to go to tribunal, the stress it puts you under is unreal. I have Ehlers Danlos syndrome, Osteoarthritis, meniers disease, Ibs,POTs and a heart murmur ,this on top of depression with pain and all this stress! I cannot believe Atos and Capita how they can be so blinkered in their reports, didn't even mention I use crutches and said I could move easily! Totally ignored I use a dosette box and can't go out alone! No mention that I have no-one to come with me and that's what I am trying to get a benefit so someone can help me! To say I am upset is an understatement. Sorry about the rant just feeling so unsupported.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
