Length of award and use of mobile phones (Pip)

If you suffer from a lifelong condition in which it has been said by a consultant I'm going to have to adjust to it for the rest of my days, can you challenge the length of an award if, for example, you have received an award for three or four years?

Being able to use a mobile phone and reading texts has recently been used to deny me the points I should have got. Is there any specific guidelines with regard to their use?

Hi Ethan

Yes you can put in for an MR or Appeal challenging the length of the award, but they won't look at that issue alone - they will look at your whole award. Be aware that not many people have succeeded in extending the length of an award, though that doesn't mean you shouldn't try.

There are no specific guidelines on how they view a claimant using a phone and reading texts. They are likely to use that knowledge to judge the level of someone's reading and cognitive abilities.

If I could show I am only able to use a phone in certain conditions and that I cannot do so reliably, safely and to a repeatable standard as reasonably required- would this negate their argument? It wouldn't change the fact that I had issues using it. I have a brain disease so the settings of the phone have been adapted to make the receiving of calls for emergency purposes a priority. There is an app on the phone that once it detects a fall automatically rings the wife. Tbh it's not even my phone it has been loaned for emergency use only.

You could but PIP does not assess your ability to use a phone, mobile or otherwise, you would do better to look at the activities that it has been used against to see whether you have adequately explained why you are unable to reliably complete them.
